What steps should I take following a workplace injury?

 

  • Immediately report the injury to your employer (The WSIB form 7 should be completed by your employer when you report the Injury).
  • Get medical treatment right away and report it as a work-related injury at an emergency room,​ walk-in clinic or your family doctor (the WSIB form 8 should be completed by your treating physician at this time).
  • Obtain the name, addresses and phone numbers of any witnesses.
  • Complete the WSIB's form 6 (you can find this form online).
  • Hire a Paralegal or Lawyer (When hiring a legal representative make sure to ask if they are licensed by the Law Society of Upper Canada).
  • Keep in contact with your employer regarding modified duties (You have a duty to cooperate).
  • Keep a notes of the conversations you have with the WSIB and your employer.
  • Appeal all decisions within the time limits set out by the WSIB.


  

What is the WSIB? 


  • It is a Government agency insurance system financed by employers which guarantees compensation to workers that suffer work-related illness or injuries. 


Can I sue my employer if I get injured at work?


  • Generally, you cannot sue your employer if they are covered under the WSIA.


HOW LONG DO I HAVE TO FILE A HUMAN RIGHT CLAIM?   


  •   An application can be filed up to one year after the discrimination or harassment. If there was a series of events, you can file up to one year after the last event. The Tribunal my give exceptions to extend this time in certain cases.
